Dying Without a Will (intestate)

The State has a will for you:

  • A life time partner gets nothing

  • A married spouse (and registered civil partner) only gets £250,000 outright if you leave children and £450,000 outright if you do not leave children.

  • Children inherit equally. No account is made of lifetime transfers. Step children do not inherit.

  • Distant relatives may inherit

  • Disputes can cause delay, expense and bitterness, particularly if you have children by a former marriage

  • If you have minor children they will inherit but a former spouse will be their guardian and so control all your assets. This can be avoided.

Writing a will is not a problem.
